1. Authorization
Property Representative hereby grants Elite Towing & Recovery written authorization to remove, tow, and impound any vehicle parked in violation of posted rules on the described property. This authorization may be: (a) On-Call — Property Representative contacts Elite Towing each time a tow is requested; or (b) Patrol — Elite Towing patrols the property on a schedule and removes violating vehicles without individual call authorization.
2. Signage Compliance
Property Representative warrants that all required signage meeting ORS 98.812 requirements is posted at all entrances to the property, including: the name and phone number of Elite Towing & Recovery, the location of the impound lot, and notice that unauthorized vehicles will be towed at the owner's expense. Property Representative is responsible for ensuring signs meet all current state and local requirements. Consult an Oregon attorney or your local jurisdiction for current size, placement, and illumination requirements.
3. Law Enforcement Notification
Elite Towing & Recovery will notify the appropriate law enforcement agency within one (1) hour of each tow as required by Oregon law, including vehicle make, model, color, license plate, and storage location.
4. Fees & Charges
All towing and storage fees are charged to the registered owner of the towed vehicle, not to the Property Representative, unless otherwise agreed in writing. Fees are set in accordance with applicable Oregon and local maximum rate schedules. An itemized invoice will be provided to the vehicle owner upon request.
5. Indemnification
Property Representative agrees to indemnify and hold harmless Elite Towing & Recovery from any claims, damages, or liability arising from: (a) inaccurate or incomplete authorization provided by Property Representative; (b) non-compliant or missing signage on the property; or (c) any misrepresentation by Property Representative regarding ownership or authority over the property.
6. Term & Termination
This Agreement is effective upon signing and continues until terminated by either party with 30 days written notice. Elite Towing & Recovery reserves the right to terminate this Agreement immediately if the property is found to be non-compliant with Oregon towing statutes.
7. Governing Law
This Agreement shall be governed by the laws of the State of Oregon. Any disputes shall be resolved in Multnomah County, Oregon.
